Huge Recall for Defibrillator Wires

An estimated 79,000 patients are still implanted with potentially faulty defibrillator wires. St. Jude Medical had stopped selling the leads last year, but the FDA has now issued a class 1 recall for Riata® and Riata® ST Silicone Defibrillation Leads.

It is classified as a class 1 recall due to the potential risk of serious injury or death if the device malfunctions, and the device has been shown to have a higher than average failure rate.

The press release, written by St. Jude Medical, states "If the electrical integrity of a lead were to be compromised, failure to deliver appropriate therapy, or the delivery of inappropriate therapy, could potentially occur, and could lead to a serious adverse event or death".

Here's an excerpt from the article by Jan Baggarly, along with a link.

Only about 60 percent of the consumers included in the survey reported ever having looked for recalled food in their homes, and only 10 percent said they had ever found a recalled food product. The study also showed that even when people find recalled food in their homes, they don’t always do what they are told to do with it. Approximately 12 percent reported eating a food they thought had been recalled.

Public Citizen Urging for Recall of Transvaginal Mesh Patch

Consumer advocate group Public Citizen has petitioned the FDA to ban all marketing for transvaginal mesh implant devices, as well as halt all manufacturing and recall all devices currently on the market.

Public Citizen states that there is no "clinically significant benefit" compared to non-mesh reparation procedures, and that the device does more harm than good.

The petition goes on to further point out problems with studies that contributed to the devices being approved, stating various flaws in the way information was gathered.

The Indy world was rocked with the news of Dan Wheldon's tragic accident, and the fiery crash scenes replayed were a horrific reminder of how dangerous the sport is. This incident comes on the heels of the tragedy at the Reno Air Races, where a plane crashed into spectators, killing many.

Over the years, and with the experience of each tragic accident, safety guidelines are increased. Sometimes measures are tightened as a result of spectators being hurt, other times, its because an athlete has suffered a severe injury, or even death.

There are always two sides to the story, though. On one hand, some fans think safety guidelines ruin the sport, and that the athletes and spectators alike take the risk of being hurt just by partaking in these activities. On the other, some fans and athletes assume that they are already being protected to the best of all parties' abilities- and if not, they believe precautions should be taken. Is it not not too much to ask that we all have fun in the safest environment possible?

Discussion Friday: Caps on Personal Injury cases

Recently, Oklahoma courthouses were flooded with lawsuits being filed in an effort to avoid the new cap set on personal injury awards. The cap, for cases after November 1st, is now set at $350,000.

For most, the average award for personal injury cases is under $350,000, but some injury attorneys are worried this will affect special cases in a negative way.

Attorney James Self, explained his dismay to Oklahoma's KFOR News:

"People who are seriously injured whose case at this time could be worth millions of dollars, after November 1, they're going to be limited to $350,000," Self said. "That means if you lose a leg, both legs, if you lose an arm, both legs, all your arms and all your legs, it's $350,000 no matter how seriously injured."

Others feel that many lawsuits, particularly medical malpractice suits, drive up the cost of insurance, and that this cap will help alleviate that reaction.

According to their website, CooperVision states:

Testosterone booster, Uprizing 2.0, recalled due to presence of synthetic steroid

In a press release posted on the FDA's website, consumers were alerted of a recall of the supplement Uprizing 2.0.

Uprizing is manufactured by Superior Metabolic Technologies Inc, of Marietta, Georgia and has been marketed as a pro hormone testosterone booster, popular in the body building community. The supplement was found to contain Superdrol, a synthetic anabolic steroid banned by the FDA.

The manufacturers are voluntarily recalling all lots of the product, and according to the press release, the supplement was distributed through retail health food stores in at least 8 states. Consumers are to receive a full refund when returned to the place of purchase.

Jennifer Jo Cobb and her JJCR team continue to persevere through the many setbacks that 2011 has brought them. This past weekend’s woes at the Kansas Speedway brought the team just to the brink of shutting down. After failing to qualify for the race in her Mark One Dodge Challenger by just 2/10ths of a second, the team immediately went into crisis mode inside her hauler while designated hosts entertained the numerous sponsors and guests on hand that day.

“People don’t realize what goes on behind the scenes in taking care of a sponsor and I was devastated to let so many of my supporters down,” said Cobb. “Everyone involved was so gracious and understanding and for that, I am most appreciative.” The Mark One Dodge had an incident in first practice where the brake line sparked on a battery cable and fixing the issue cost the team much needed time to dial the car in. When second practice resumed, a faulty gear locker was discovered which took all but a few practice laps away from the Kansas City, Kansas native. Cobb states, “If it could have gone wrong, it did. We even had two crew members hurt, with one ending up in the hospital and the other with stitches - and this happened after our car was out of contention.”

With such devastation abound, missing the race and the financial payout from NASCAR was the final blow for the team. “I am a professional speaker and I whole heartedly believe in perseverance but my perseverance had run completely dry on Saturday.” That is where the story begins to turn around.

Misconceptions about the "Hot Coffee" incident

The lawsuit brought against McDonalds in 1994 is common knowledge- but is often the subject of gross misinformation.

The butt of many jokes, the Liebeck v. McDonald's case has been passed from person to person, much like a childhood game of "telephone". It's no wonder the general public often misquotes the case. Here's how it really happened.

Stella Liebeck and her grandson (who was driving, by the way- NOT Liebeck, as is often talked about) ordered a coffee through the drive-through. Liebeck asked to stop the car to add sugar and cream, and in the process of removing the lid, the 79-year old woman spilled the coffee on her lap, causing serious burns. So serious, in fact, that skin grafts and a 2 week hospital stay was necessary.

She did not sue for millions, she only asked for her hospital bills and lost wages to be paid, which was around $20,000 at the time. McDonald's originally offered her $800.

McDonald's brewed their coffee at a piping hot 180-190 degrees, which is capable of causing 3rd degree burns in a matter of seconds. What most people aren't aware of, is that there were nearly 700 other cases before this that McDonald's settled, while refusing to lower their brewing temperature.

The jury found McDonald's at fault for negligence, and after the judge reduced the penalties, Liebeck was awarded $640,000. She settled out of court for an undisclosed amount.

Contaminated alcohol wipes responsible for infections, death

Two deaths, and possibly a third, have been linked to tainted cleansing wipes used frequently in hospitals.

On January 5, 2011, the FDA ordered a mass recall of nearly $6 million in products by Wisconsin-based medical product manufacturer Triad, after it was discovered that some products had been contaminated by the Bacillus cereus bacteria.

Bacillus cereus is typically associated with food borne illnesses, and is potentially fatal.

So dangerous, in fact, that the family of a 10 year old boy already battling leukemia, had to come to terms with the fact that the bacteria -not leukemia- might claim their son's life. After intense treatment, their son survived, but faced major setbacks in his leukemia treatment.

Sadly, another family lost their 2 year old son, who contracted bacterial meningitis when the contaminated product was used on him after surgery. Additionally, a 66 year old man died after her became infected with the bacteria while being treated for skin cancer and diabetes.

A third death is purported to be a 68 year old woman in the process of suing Triad for also being infected, who died just days before her deposition. An autopsy will be ordered to determine if the infection, caused by Triad's products, was responsible for her death.

Interestingly enough, the FDA was aware of Triad's improper procedures in ensuring sterilization as early as July 2009, when a high number of abnormal pap smears were found to be linked to Triad's sterile lubricating jelly. Around this time, FDA reports specifically call out Triad for not following proper procedures to prevent microbiological contamination.

With that information, the FDA would typically issue warning letters, which would set in motion the need for documented compliance and follow-ups, but no letters were issued.

In addition to the mass product recall, Triad has been banned from further producing medical supplies until their reconditioning plan has been awarded federal approval.

Transvaginal mesh recipients need to read this important update!

Recipients of a transvaginal mesh patch are at risk for serious complications, and if affected, may be entitled to compensation.

Transvaginal mesh implants are used in the treatment of pelvic organ prolapse (POP) and stress urinary incontinence (SUI), which occurs when tissue that holds the organs in place is stretched, resulting in bulging. Nuvaring lawsuit update

According to AboutLawsuits.com, a Virginia man has filed a complaint against Merck and Organon (a division of Merck) for their vaginal contraceptive, Nuvaring.

Alberta Horne died in 2009, as a result of a pulmonary embolism. It is alleged that Horne's use of Nuvaring lead to the fatal blood clot. The lawsuit was filed by the woman's husband, Eric Horne, and joins the list of hundreds of other lawsuits alleging similar side effects.

Defective product advertising- potentially annoying, but effective

We've all seen commercials targeting consumers who have been affected by defective products and dangerous drugs. They're usually dramatic and attention getting, which usually adds up to one thing-annoying. In fact, if asked to describe these commercials, the farthest thing from anyone's mind would be life-saving.

This is exactly what this advertising meant to a New Orleans man, who had received a Zimmer hip replacement in 2007. After suffering serious complications from the device for years, Francoie Stephens was alerted of the device recall while watching television. He had no idea that the product was defective, and that it's design was the cause of all of the complications following surgery.

Zimmer has been accused of negligence and faulty engineering with not only their Durom hip cup replacement, but also a knee replacement device. Clinical trials were not performed prior to releasing the product, and it is alleged that the company did not inform consumers and medical professionals about the problems after Zimmer became aware of them.

Fosamax Litigation Update

Aboutlawsuits.com has reported that yet another claim has been filed against Merck for their osteoporosis drug, Fosamax. Lois Takamori of Hawaii, experienced sudden, unexpected femur breakage while stepping backwards at her gym. She had been taking Fosamax for 8 years for osteoporosis, but is otherwise healthy. Takamori's case is one of over 100 lawsuits filed against Merck for femur fractures, allegedly as a result of prolonged use.

Darvon- nearly 50 years of harmful side effects

Darvon (Propoxyphene) has been widely prescribed for nearly 50 years for arthritis and mild to moderate pain with or without a fever. It is a narcotic analgesic. Darvocet is a form of the drug that is paired with acetaminophen, which increases it's efficacy. The drug has faced controversy since 1978, after it was discovered that the drug led to cardiac effects such as arrhythmia and heart toxicity. A recent study confirmed that propoxyphene can interfere with the electrical activity of an otherwise healthy heart. The makers of Darvon and its other forms have been under fire continuously since then, including multiple requests for FDA banning, since many reports have surfaced regarding the potentially lethal side effects. These side effects include:

Heart abnormalities
Heart arrhythmia
Heart electrical changes
Heart attack
Addiction
Respiratory depression
Overdose
Suicide
Accidental Death

An estimated 100,000 deaths from Darvon/Darvocet since 1957 have finally resulted in a mass recall, and the drug has been banned by the FDA as of November 2010. There are currently class action lawsuits being filed for injuries related to the drug, and individuals harmed by the drug are encouraged to join the class action suits, or seek representation and file individually.

Defective products: Zimmer NexGen knee replacement failure

The Zimmer NexGen knee replacement component has been linked to a high rate of failure in which patients experience loosening of the product within two years, in one study, as many as 36% of patients experienced negative side effects. Typical knee replacements require a type of cement, which this specially designed orthotic does not use.

Zimmer quietly recalled some NexGen MIS components in 2010 due to manufacturing or design defects, followed by a Nexgen LPS recall due to nonconforming and inconsistent geometry.

Zimmer, Inc has been under scrutiny since 2008, when their hip replacement orthotic, the Durom hip cup, also showed signs of early failure. Dangerous Drugs and Defective Products

Sometimes, it's marketing a product for a use that the FDA didn't approve it for. All of these can have very disastrous results.

Take the recent trials of Topamax, for example. Topamax (Topiramate) is an anti-seizure drug manufactured by Ortho-McNeil, that was promoted for off-label (unapproved) uses such as depression and bipolar disorder. The drug was prescribed to pregnant women, and it was discovered that it doubled the risk of their unborn child developing facial and genital deformities.

Accutane, made by Hoffmann- La Roche is another example of irresponsibility. Originally designed for the most extreme cases of acne, the drug was often prescribed for far less severe incidents. Some patients developed inflammatory bowel diseases, resulting in lifelong struggles, and in extreme cases, sections of intestines having to be removed.

There are many other cases like these, and class action lawsuits form continuously to help consumers gain compensation for their pain and suffering. Pharmaceutical companies attempt to combat this by offering measly settlements, and throwing more money into advertising.

Knowing this, it's easy to develop a lack of trust for doctors and drug makers, but you, as a consumer, won't benefit from halting medical care out of mistrust. What you CAN do, is be informed. Ask your doctor questions and feel free to research any drugs that are prescribed. Defective products: Zimmer hip replacement failure

Zimmer, Inc is yet another company responsible for defective metal-on-on metal orthotics. The FDA allowed Zimmer to market and sell their Durom hip cup without clinical trials. Between 2006 and 2008, 12,000 patients had received this hip cup replacement. This specially designed orthotic was intended for use in young and active patients, who would likely outlive the standard hip replacement orthotic being used.

Longevity was not on Zimmer's side, as it became apparent that a high number of patients were experiencing failures within 2 years. Dr. Lawrence Dorr, well known and respected in the orthopedic community, called attention to these alarming numbers. The response from Zimmer was to immediately shift blame to the surgeons. In a statement released in 2008, Dr. Dorr confirmed that the orthotics that had been removed had no bone growth on the back of the cup despite it's design to encourage growth, and observed that some of the orthotics were moving.

Zimmer halted sales in July 2008 and is currently under scrutiny following many injury claims from their hip replacement, as well as another failed knee orthotic.

Defective products: The DePuy disaster

The DePuy Hip replacement has been called "a medical disaster". A metal hip replacement orthotic manufactured by DePuy Orthopaedics, Inc. (a division of Johnson & Johnson) has been shown to fail in nearly 49% of recipients. The orthotic, which was designed to last 15 years, has failed in less than half that time in most cases, with patients reporting major complications in an average of 6 years.

The orthotics have already been implanted in patients, and have been responsible for damages such as bone necrosis, bone staining, swelling, nerve damage, infection, and fracture. In addition, even if the patient receives a second replacement to remove the failed orthotic, dangerous fragments can be left behind that can lead to continuous and potentially lethal problems.

Nearly 93,000 patients have received these implants, and with a tentative failure rate at 13% (but projected to be as high as 49%) many claims are in the process of being filed against DePuy. These failures have prompted one of the largest orthotic recalls in history. Claimants are seeking representation to file claims on a case-by-case basis, and several class action lawsuits have been filed.

TSGLI helps traumatically injured service members and their families with financial burdens with a one-time payment. The amount varies depending on the injury, but it could be the difference that allows their family to be with them during recovery, helps them with unforeseen expenses or gives them a financial head start on life after recovery.

All members of the service who have full-time or part-time SGLI are automatically covered by TSGLI while the member is in service.

TSGLI is not meant to serve as an ongoing income replacement, it's there to help the Soldier through the tough times that occur as the result of a traumatic injury. TSGLI will not affect your VA Disability.

Fosamax injury and lawsuit information

Fosamax (Alendronic acid ) is a Bisphosphonate drug made by Merck that has been popularly prescribed for osteoporosis. There are also generic versions of the drug made by Teva Pharmaceuticals and Barr Pharmaceuticals. By 2000, it was discovered that it contributed to problems such as osteonecrosis of the jaw and femural fractures. The drug contains oral bisphosphinates, which, after long-term use, can make bones more brittle and result in low-impact fractures. A doctor reported an incident of an otherwise healthy 59 year old woman who had been taking Fosamax for 7 years, who suffered a snapped femur while standing on a train. In 2011, Fosamax's detriment became more widely known, as General Hospital actress Sharon Wyatt filed a claim against the makers of Fosamax due to her complications with osteonecrosis (deterioration) of the jaw. Hundreds of other cases have surfaced in recent years, ranging from fractures to cases like Sharon Wyatt's.

The FDA ordered warnings on Fosamax labels in 2010. The drug hasn't been removed from the market, but injury claims are being filed daily by individuals and attorneys, and anyone suffering injuries after taking Fosamax is encouraged to seek representation.

NuvaRing- Another contraceptive under investigation

NuvaRing, a suppository-style contraceptive manufactured by Merck, is one of the most popular birth control options on the market today. It is formed as a flexible plastic ring that contains a combination of hormones consisting of ethinyl estradiol and etonogestrel. The ring style is unique, and has been widely received as more convenient, as there are no daily doses to remember.

Unfortunately, this combination of hormones has been shown to elevate the risk of blood clots, strokes, and more. The hormones in NuvaRing have the potential to change the body's blood-clotting system, which can lead to problems such as pulmonary embolism- a life-threatening event in which a blood clot can pass through the body into the lungs. Blood clots are extremely dangerous, and can lead to any of the following events:

• Deep vein thrombosis (DVT)
• Pulmonary embolism (PE)
• Stroke 
• Heart attack 
• Gallbladder problems

To date, there have been over 40 deaths associated with NuvaRing, and over 730 lawsuits filed against Merck. It is speculated that there is an elevated risk with these contraceptives due to the newer “generation” of hormones being used, as opposed to the traditional oral contraceptives that have been on the market for quite some time. Many more women are coming forward with information regarding their severe side effects from taking NuvaRing.

The painful side of Levaquin

Levaquin (levofloxacin) is a broad-spectrum antibiotic used to treat infections of the lungs, skin, sinus and urinary tracts. There are several forms of the medication, including 3 levels of tablets, and 2 oral solutions. It has been manufactured by Johnson & Johnson and Ortho-McNeil Pharmaceuticals since 1997 and maintained popularity until 2008, when it was discovered that Levaquin was linked to tendon ruptures and other injuries.

The FDA has ordered Ortho-McNeil to place black-label warnings on all forms of the medication. Nearly 2,600 cases of injuries as a result of taking the medication have been reported, and these injuries range from tendon rupture, inflammation, Achilles tendonitis, shoulder injuries, and injuries to the biceps, hands and thumbs. Other side effects include the following:

Nausea, diarrhea, abdominal pain, dizziness, rash and vaginitis in women
Allergic reactions
Phototoxicity (sensitivity to light)
Diabetes
Tremors, anxiety, confusion, hallucinations, and in extreme cases, suicidal thoughts or actions

So far, claims are being filed by individuals and lawyers, and a class action lawsuit has not been started. Levaquin is still available with a prescription, despite these reports of potentially severe complications.

Birth defects caused by Topamax

Anti-seizure medication Topamax (Topiramate) has recently been linked to an increased risk in oral clefts (cleft palate and cleft lip) when used by pregnant women. Oral clefts occur when the two plates that form the roof of the mouth do not join, leaving a gap. These clefts can range from a small indent in the lip, to a large gap in the roof of the mouth, extending all the way to the nose.

Topamax is manufactured by Ortho-McNeil Neurologics, and many generic versions of Topiramate are being made by a range of other companies. Pregnant women exposed to Topiramate in their first trimester experience a fully doubled risk for birth defects, as shown by a recent study. There is also evidence that Topamax may be riskier than other anti-seizure medications, as the risk jumps from .38%-.55% for other medications, to a 1.4% risk for Topamax users.

On March 4th, 2011, the Food and Drug Administration issued warnings to the public about the increased risk of birth defects caused by Topamax. This warning comes 3 years after reports concluded the increased risk for birth defects was known by the FDA. Ortho-McNeil has also been under fire previously for promoting the medication to physicians for “off-label” uses that hadn't been approved.

Yaz, Yasmin and Ocella: Contraceptives that may increase health risks

Yaz and Yasmin, manufactured by Bayer, are some of the most popular birth control medications on the market today. They were created with a unique combination of hormones unseen in any other contraceptive. This combination of ethinyl estradiol and progestin drospirenone (DRSP) effectively treats acne and premenstrual dysphoric disorder (PMDD) symptoms; functions that have been strongly marketed to young women. Yasmin and Yaz differ only in that the newer Yaz contains a lower concentration of the same hormones. The success of Yaz led other companies such as Teva Pharmaceuticals to follow suit with a generic version of the contraceptive called Ocella.

Unfortunately, this combination of hormones has been shown to elevate the risk of blood clots, strokes, and more. Yaz, Yasmin and Ocella have the potential to change the body's blood-clotting system, which can lead to problems such as pulmonary embolism- a life-threatening event in which a blood clot can pass through the body into the lungs. Blood clots are extremely dangerous, and can lead to any of the following events:

• Deep vein thrombosis (DVT) 
• Pulmonary embolism (PE) 
• Stroke
 • Heart attack
 • Gallbladder problems

To date, there have been over 50 deaths associated with Yaz, as as many as 140 deaths associated with Yasmin. Many more women are coming forward with information regarding their severe side effects from taking these contraceptives.

Avandia Class Action Lawsuit information

GlaxoSmithKline's popular type 2 diabetes medication Avandia (Rosiglitazone) has been linked to serious life-threatening side effects, including a 43% increase in heart attacks and related cardiovascular events. GSK been under investigation regarding the medication after nearly 13,000 claims for damages have been filed. Some of the more serious side effects include strokes, heart attacks, and congestive heart failure. The FDA received reports of 1,354 deaths related to Avandia.

Despite the increased awareness of the drug's risks, the FDA has not recalled Avandia in the US. In 2010, the FDA simply placed restrictions on the drug, stating it could only be prescribed to patients who did not respond to other treatments, as well as adding a “black-box” label, warning users of the drug's increased risk of congestive heart failure and heart attack. However, the European Medicines Agency has completely halted production of Avandia.

In 2010, GlaxoSmithKline agreed to pay $460 million to settle some of the claims filed against them, with an expectation of paying nearly $6 billion in liabilities after everything has been settled.
